Thailand Real Estate
It is not easy to acquire real estate in Thailand if you are not a resident. According to Thai law, a foreigner can not own land in his name. They can own buildings but not the property they are sitting on. If a foreigner wants to buy land to build on they can either purchase a 30 year lease or they can purchase the freehold of the land through his business he is going to operate in Thailand. The land will be owned by the business and not the individual. The 30 year lease has an option to be extended for another 30 year lease after that one has expired. The home or building that is built on the land by the one who leases it, cannot be taken from them when the lease on the property expires. The lessor cannot seize the property that is on the land.

Thailand has many different types of land titles. There are three titles that are recommended. These are the Nor Sor 3, the Nor Sor 3 Gor, and the Chanote. Years ago the land was in the hands of the people and they reserved the right use the land and transfer it to their heirs. During the Ayuthaya and the Ratanakosin era, the land was owned by the kings and the people had to request a royal grant to obtain the land.

The two types of rights to private land today and they are the Possession Right, and the Ownership. The Possession Right gives people the right to possess the land under the Civil and Commercial Code. The Ownership type gives the people the right to a title deed and documents concerning the land.

If anyone wanted to invest in real estate in Thailand it would not be hard to do because they are always looking for investors. There can be as much as 15% or more interest (sometimes as much as 50% depending on the time involved) made per year or two on your initial investment. Many developers need investors to help them with their projects because it is hard for a foreigner to get a loan at a bank in Thailand. In some cases the developers will offer a partnership in the company and the investor will get a percentage of the shares. Sometimes the developer has enough money to purchase a large parcel of land but does not have enough to build on it. This is where the investor comes in.
